Este sitio web, incluyendo el conjunto de páginas web que lo integran, (en adelante “Sitio Web”) pertenece a PYRENEES&MORE, a través del cual los usuarios o clientes del mismo (en adelante “Usuario” o “Usuarios”) pueden acceder a diversa información y servicios sobre viajes y turismo.

Todo acceso a este Sitio Web está sujeto a todas y cada una de las presentes Condiciones Generales de Utilización del Sitio Web (en adelante, “Condiciones Generales”), en la versión publicada y vigente en el mismo momento en que el Usuario acceda al Sitio Web. Por tanto, es obligatorio que el Usuario lea atentamente las Condiciones Generales antes de utilizar el Sitio Web, así como las condiciones particulares que, en su caso, complementen modifiquen o sustituyan a las Condiciones Generales en relación con determinados servicios y contenidos del Sitio Web, dado que las mismas podrían haber sufrido modificaciones desde la última vez que accedió al mismo.

El Usuario declara que es mayor de edad y tiene la capacidad legal para adquirir los servicios ofrecidos a través del Sitio Web.

Queda prohibido el acceso al Sitio Web a los Usuarios que residan en jurisdicciones en los que su contenido esté no autorizado.

  1. Contratación de servicios a través del sitio web

El presente Sitio Web está dirigido al consumidor final, y sólo podrá utilizarse con el fin de recabar información para realizar una compra en el mismo, no permitiéndose su utilización para otros fines sin el consentimiento expreso y por escrito del titular de este Sitio Web.

Con carácter enunciativo pero no limitativo, no está permitido:

  1. a) Utilizar el Sitio Web contraviniendo la legislación vigente, la buena fe, los usos generalmente aceptados y el orden público.

  4. d) Incluir información del Sitio Web en herramientas de búsqueda comparativas de precios.
  5. e) Acceder al Sitio Web mediante un robot, araña o cualquier herramienta o programa automático de búsqueda.
  6. f) La realización de búsquedas masivas en proporción a las compras realizadas en el Sitio Web.
  7. g) Realizar solicitudes o contrataciones especulativas, falsas o fraudulentas.

Sin perjuicio de lo anterior, PYRENEES&MORE se reserva el derecho a denegar en cualquier momento, sin necesidad de aviso previo y sin derecho a indemnización, el acceso al Sitio Web, a aquellos Usuarios que incumplan las presentes Condiciones Generales, o las particulares que en cada caso les sean de aplicación. Si PYRENEES&MORE tuviera motivos razonables para considerar que se ha hecho un pedido contraviniendo las presentes Condiciones Generales estará autorizado a anularlo y podrá informar a las autoridades pertinentes.

Los Usuarios deben saber que la contratación de los servicios antes mencionados está regida por las condiciones contractuales específicas o particulares, según la legislación aplicable en cada caso, que sean acordadas por los Usuarios con el Prestador del Servicio de los mismos y PYRENEES&MORE.

En especial las siguientes condiciones se aplicarán con carácter general:

  1. Navegador y sistema operativo

Las pantallas del Sitio Web están optimizadas para su utilización con los navegadores Internet Explorer 6 y Firefox 2 (y versiones superiores), Safari, Chrome y Opera bajo entornos Windows, Mac y Linux. PYRENEES&MORE no se responsabiliza de los resultados ni perjuicios que pudiera ocasionar a los Usuarios por la utilización de otros navegadores, versiones distintas, o sistema operativo, distintos para los que ha sido diseñado el Sitio Web.

La información contenida en el Sitio Web es ofrecida para conveniencia de los Usuarios. PYRENEES&MORE realiza los máximos esfuerzos para evitar cualquier error en los contenidos que pudieran aparecer en el Sitio Web. Sin embargo, PYRENEES&MORE no es responsable de la información que el Usuario pueda obtener a través de enlaces a sistemas externos que no sean dependientes de PYRENEES&MORE.

PYRENEES&MORE adopta medidas de seguridad razonablemente adecuadas. No obstante, el Usuario debe ser consciente de que las medidas de seguridad de los sistemas informáticos en Internet no son enteramente fiables y que el servicio depende de elementos externos e internos vulnerables.

No obstante, PYRENEES&MORE no se responsabiliza ni garantiza que el acceso al Sitio Web sea infalible, continuo o libre de deficiencias. Asimismo, tampoco PYRENEES&MORE será responsable por los daños y perjuicios de cualquier naturaleza que se deriven del uso del Sitio Web, incluyéndose pero no limitándose, a los ocasionados a los sistemas informáticos o los provocados por un uso inadecuado del Sitio Web, interrupciones o defectos en las telecomunicaciones que pudieran ocurrir en operaciones de naturaleza financiera o análogas, o los causados por terceras personas mediante intromisiones ilegítimas fuera del control de PYRENEES&MORE.

  1. Propiedad intelectual

Los derechos de propiedad intelectual del Sitio Web, su código fuente, diseño, estructura de navegación, software, bases de datos y los distintos elementos en ella contenidos son titularidad de PYRENEES&MORE, correspondiéndole el ejercicio exclusivo de los derechos de explotación de los mismos en cualquier forma y, en especial, los derechos de reproducción, modificación, distribución, comunicación pública, cesión, puesta a disposición y transformación.

Todas las denominaciones, diseños y/o logotipos que componen este Sitio Web son marcas debidamente registradas. Cualquier uso indebido de las mismas por persona diferente de su legítimo titular podrá ser perseguido de conformidad con la legislación vigente.

Los derechos de propiedad intelectual y marcas de terceros deben ser respetados por todo aquel que acceda al Sitio Web, PYRENEES&MORE reconoce a favor de sus titulares los correspondientes derechos de propiedad industrial e intelectual, no implicando su sola mención o aparición en el Sitio Web la existencia de derechos ni de responsabilidad alguna sobre los mismos, como tampoco respaldo, patrocinio o recomendación.

A los efectos de preservar los posibles derechos de propiedad intelectual, en el caso de que cualquier Usuario o un tercero considere que se ha producido una violación de sus legítimos derechos por la introducción de un determinado contenido en el Sitio Web, deberá notificar dicha circunstancia a PYRENEES&MORE, indicando:

– Acreditación suficiente de los derechos de propiedad intelectual.

PYRENEES&MORE, dentro del Sitio Web, puede poner a disposición de los Usuarios conexiones y enlaces a otros sitios web gestionados y controlados por terceros. PYRENEES&MORE no patrocina o garantiza ninguno de estos sitios Web de terceros, los cuales han sido incluidos por conveniencia para los Usuarios. Por lo tanto, no asume ningún tipo de responsabilidad, ni siquiera de forma indirecta o subsidiaria, por los daños y perjuicios de toda clase que pudieran derivarse del acceso, mantenimiento, uso, calidad, licitud, fiabilidad y utilidad de los contenidos, informaciones, comunicaciones, opiniones, manifestaciones, productos y servicios existentes u ofrecidos en los sitios web no gestionados por PYRENEES&MORE y que resulten accesibles a través del Sitio Web.

Queda prohibido anunciar u ofrecer en venta cualquier tipo de bienes o servicios, ni llevar a cabo encuestas o concursos, ni enviar mensajes solicitando su reenvío en cadena.

PYRENEES&MORE, por norma general, no revisa, ni filtra, ni aprueba el contenido de los Usuarios. No obstante lo anterior, PYRENEES&MORE se reserva el derecho a retirar cualquier contenido facilitado por el Usuario que sea contrario a las Condiciones Generales, así como a impedir o prohibir su acceso al Sitio Web, todo ello a su sola discreción, sin previo aviso y sin que el Usuario tenga derecho a indemnización alguna.

Si el Usuario creyera, en algún momento, que los contenidos de otro Usuario no cumplen con las Condiciones Generales, puede notificarlo a PYRENEES&MORE por correo electrónico al Centro de Atención al Cliente. A la recepción de cualquier notificación de este tipo, PYRENEES&MORE utilizará sus mejores esfuerzos para eliminar de su Sitio Web aquellos contenidos que pudieran vulnerar las Condiciones Generales.

PYRENEES&MORE cooperará, si es requerida por orden judicial o por las autoridades pertinentes, en la identificación de las personas responsables de aquellos contenidos que infrinjan la ley.

El Usuario autoriza que las imágenes o contenidos que facilite en el Sitio Web puedan ser utilizados por PYRENEES&MORE, en su totalidad o en parte, con carácter gratuito. Todo ello con la única salvedad y limitación de aquellas utilizaciones o aplicaciones que pudieran atentar al derecho al honor, a la moral y/o al orden público, en los términos previstos en la legislación vigente en cada país. PYRENEES&MORE se exime de responsabilidad sobre cualquier uso que pueda hacer un tercero de dichos contenidos.

 

  1. Nulidad parcial

Debido a la descentralización de la función legislativa y de control del marco jurídico que afecta a la actividad que desarrollan las agencias de viajes, es posible que las Condiciones Generales estén sujetas a diversas jurisdicciones o normativas. Por ello, en el supuesto de que alguna condición de las Condiciones Generales fuese nula o anulable, la validez del mismo en su conjunto no quedará afectada por dicha circunstancia.

La condición legalmente inefectiva será sustituida por una nueva, o interpretada de un modo legalmente aceptable, que sea de un tenor lo más aproximado posible a la condición que se habrían formalizado de haber tenido conocimiento de la ineficacia de la condición en cuestión.

 

  1. Exigibilidad

El hecho de que PYRENEES&MORE no exija en una ocasión el cumplimiento por el Usuario de alguna condición de las Condiciones Generales, no afectará en modo alguno a su derecho a exigir su cumplimiento en una ocasión posterior o al derecho de cualquier otra parte a exigir su cumplimiento.

Cualquier renuncia por PYRENEES&MORE a cualquiera de los derechos o facultades derivados de las Condiciones Generales deberá realizarse por escrito. La omisión por PYRENEES&MORE a exigir el estricto cumplimiento de cualquier condición no podrá ser considerada en ningún caso como una renuncia, ni privará a PYRENEES&MORE del derecho a exigir posteriormente el estricto cumplimiento de los mismos.

  1. Ley y jurisdicción

Las presentes Condiciones Generales se rigen en todos y cada uno de sus extremos por la ley española y las partes se someten al fuero de los Juzgados y Tribunales de Madrid capital, para cuantas acciones y reclamaciones pudieran derivarse de la presente relación, siempre y cuando no se estableciese un fuero específico por ley.

PYRENEES&MORE podrá ofrecer la oportunidad de que el Usuario pueda acceder a su Sitio Web en distintos idiomas. No obstante, ante cualquier conflicto o interpretación contradictoria entre las Condiciones Generales de las distintas versiones, deberá prevalecer la versión en lengua española sobre el resto.

If the User believes, at any time, that the contents of another User do not comply with the General Conditions, they can notify PYRENEES & MORE by email to the Customer Service Center. Upon receipt of any notification of this type, PYRENEES & MORE will use its best efforts to eliminate from its Website those contents that could violate the General Conditions.

PYRENEES & MORE will cooperate, if required by court order or by the pertinent authorities, in identifying the persons responsible for those contents that violate the law.

The User authorizes that the images or content provided on the Website may be used by PYRENEES & MORE, in whole or in part, free of charge. All this with the sole exception and limitation of those uses or applications that could undermine the right to honor, morals and / or public order, in the terms provided in the legislation in force in each country. PYRENEES & MORE disclaims responsibility for any use that a third party may make of said content.

 

  1. Partial nullity

Due to the decentralization of the legislative function and control of the legal framework that affects the activity carried out by travel agencies, it is possible that the General Conditions are subject to different jurisdictions or regulations. Therefore, in the event that any condition of the General Conditions is null or void, the validity of the same as a whole will not be affected by said circumstance.

The legally ineffective condition will be replaced by a new one, or interpreted in a legally acceptable way, that is of a tenor as close as possible to the condition that would have been formalized had they had knowledge of the ineffectiveness of the condition in question.

 

  1. Enforceability

The fact that PYRENEES & MORE does not demand on one occasion the compliance by the User of any condition of the General Conditions, will not affect in any way its right to demand its compliance at a later time or the right of any other party to demand its compliance.

Any waiver by PYRENEES & MORE of any of the rights or powers derived from the General Conditions must be made in writing. The omission by PYRENEES & MORE to demand strict compliance with any conditions may not be considered in any case as a waiver, nor will it deprive PYRENEES & MORE of the right to subsequently demand strict compliance with them.

  1. Law and jurisdiction

These General Conditions are governed in each and every one of its extremes by Spanish law and the parties submit to the jurisdiction of the Courts and Tribunals of Madrid (capital of Spain), for any actions and claims that may arise from this relationship, as long as not a specific jurisdiction is established by law.

PYRENEES & MORE may offer the opportunity for the User to access its Website in different languages. However, in the event of any conflict or contradictory interpretation between the General Conditions of the different versions, the Spanish version must prevail over the rest.
